FOIA #118

I am making the following FOIA request.

As per the US Department of Education, FERPA General Guidelines it indicates the following:
Annual Notification
A school must annually notify students in attendance that they may:
Inspect and review their education records:
Seek amendment of inaccurate or misleading information in their education records;
Consent to most disclosures of personally identifiable information from education records.

The annual notice must also include:
Information for a student to file a complaint of an alleged violation with FPPC;
A description of who is considered to be a legitimate education interest so that information may be shared with that individual; and Information about who to contact to seek access or amendment of education records.

Please provide me with copies of the documents on how FCPS notified their students regarding the annual notice.

FERPA complaint

Mr. MoniuszkoThank you for your response but I will still be filing a FERPA complaint because I feel that FCPS is not taking this matter seriously. The disclosure of a student’s record without their consent should not be taken lightly and the attitude of your office that the PTAs and Boosters are free to do whatever they want is frankly disturbing. SOMEONE at FCPS gave those records to these outside organizations in clear violation of both FERPA and FCPS’s own policies on the management of student records. When FCPS singles out a particular group (football or baseball team) and takes it upon themselves to disclose student GPAs, they not only violate the privacy of that individual, but they also humiliate the students who were not included on the list.

As an educator, I am sure you are aware that there are a number of students who are learning disabled and some who also suffer from low IQs. Hard as they may try, they will never make “honor roll”. To single out a group of students and at the same time identify those who “fail”, is quite disturbing in my mind. I am always willing to work with FCPS to correct the areas where there are rules violations, but your continued indifference to these employees who blatantly break the rules and harm children, requires me to seek an outside party to correct this matter.

FOIA REQUEST #117

As per the US Department of Education, FERPA General Guidelines it indicates the following:
Disclosure of Education Records
A school must:
Have a student’s consent prior to the disclosure of education records;
Ensure that the consent form is SIGNED and dated and states the purpose of the disclosure.
Based on the above please provide me copies of the signed consent forms that were used in 2007 at Madison HS to post grades of students on the Madisonbaseball.com web site and the copies of signed consent forms that were used in 2007 at Centerville HS to post grades of students on the wildcatnations.org football web site.

It is my understanding that this has been going on for years.
I believe the above without signed consent forms is a violation of FERPA rules.
Please let me know the cost of this request.

FCPS Volunteers

Mr. Jansen
It was a complete shock to me regarding your comments about volunteers in all FCPS sport programs. In almost two years of working with you, I was never told that there was anything other then coaches who go thru the following:

Background checks
Sign contract
Receive VHSL and FCPS training

Please tell me what are the FCPS rules regarding volunteers and what they can do and what they cannot do. Also what if any of the above do volunteers have to do or complete?

In review of regulation 1530.2 please indicate to me how many volunteers were there in 2006 and 2007. Did these volunteers sign in and sign out regarding their hours of work? Did any of these volunteers get paid?

If you do not train them and they come in contact with players/parents how will they know the rules and the possible conflicts with FCPS rules? What if they promote there commercial businesses? What about student abuse?

Thank you for taking the time to meet with me today. I await your answers to our questions/issues.
Based upon what Mr. Jansen indicated to us in his email regarding posting of students grades, we will be filing a formal complaint with the FERPA.

The below is the answer to my question from FCPS. Take note that it will take over a year to improve the weight lifting program in FCPS. How many students have been hurt and will get hurt because there are no content standards, benchmarks and essential knowledge.


Instructional services are finalizing the content standards, benchmarks and essential knowledge. The entire POS (support documents) will not be ready by the all county in-service so they will distribute a draft, provide an opportunity for feedback, and distribute the final in January. The all county in-service will review the new POS and have a special session on safety

Weight lifting program fall changes?

As per the MOU, I am asking the following questions:

You indicated to me on several occasions that FCPS would be making changes to improve it’s weight lifting program in the fall. Please indicate to me what changes you are going to make to insure the safety of all students?

If you do not want to respond to this request, please indicate and I will address this issue with Mr.Moniuszko on Wednesday.
